These Terms apply in relation to any services we provide you, and it overrides any inconsistent terms or conditions (unless we specifically sign a document agreeing otherwise).

You must accept these terms and conditions, including all other policies and terms and conditions expressly referenced in these terms and conditions ('Terms') before you can use, access or subscribe to our Website.

By clicking the "I Accept" button, or accessing or using our Website, you represent that you have read, understand, and agree to be bound by the Terms. If you do not agree to the Terms, you must cease using or accessing our Website.

Our Website MUST NOT be accessed by individuals under the age of 18. If you are under the age of 18, please immediately cease use of this Website.

Firstly, Some Definitions…

In these terms and conditions:

Service Advertiser means an individual providing sexual services, intimacy services, massage services, or any other services as described in their advertisement.
Content means any information, data, text, audio, video, images, GIFs, personal data, content or material uploaded to the Website, including Service Advertiser's profile details such as phone number, email addresses and other social media handles.
Customer or You/Your means any person who visits or uses the Website.
Transaction means any monetary, barter, or other transaction that takes place between You and the Service Advertiser as consenting adults.
Terms means these terms and conditions as well as all other policies and terms and conditions expressly referenced in these terms and conditions.
Third parties means all officers, employees, agents and related bodies corporate of us or you.
Website means the website located at seductivesecrets.com.au

WHO ARE WE?

We are an online directory that provides a platform for Service Advertisers to advertise their services and upload Content, and for Customers to view and access that Content and connect with Service Advertisers. We are an independent party, and any Transaction that takes place between a Service Advertiser and a Customer is strictly between those parties. We are not involved in, nor do we facilitate or participate in, any such Transactions.

HOW DO WE WORK?

When you use our Website, you may view Content such as a Service Advertiser's phone number, email address and other profile contact information, which is provided to enable you to communicate, connect, interact and transact with the Service Advertiser. This information may also include links to other sites, such as social media handles.

We are not an escort agency, nor do we employ or contract any Service Advertisers. We are in no way liable or responsible for any Transaction between You and the Service Advertiser. We likewise cannot guarantee the quality, safety, legality, accuracy or reliability of a Transaction or of the interaction, information or offer communicated through a Transaction.

We are not liable for any disputes, claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs, that may arise out of your connection, interaction or relationship with a Transaction, including any reliance upon any information or Content or other content that a Service Advertiser may provide you.

HOW DO YOU REGISTER WITH US?

You do not need to create an account with us to view and access the Content on our Website. However, if you wish to access benefits such as notifications about new Service Advertiser profiles or the ability to read and write testimonials, you must be an eligible user and register an account with us to use our or access our Website. You must provide a unique username, a valid email address, and a password to register an account with us.

To be an eligible user:

You must be at least 18 years old (which you must confirm with us when registering an account);
You must be permitted by the laws of the State or Country in which you are located, and which apply to you to use or access our Website and any other services or content that may be available on or facilitated by our Website.

(collectively, ('Eligible User')).

If you are not an Eligible User, you must not register with us nor access or use our Website.

You are solely responsible for the security and protection of your account details, including your username and password. You are solely responsible for all activities that occur on and under your account.

You can verify your account and earn a verified badge next to your profile by emailing a copy of government-issued photo identification document, such as driver's license or passport, to hello@seductivesecrets.com.au. We will handle your identification document with the utmost confidentiality. It will not be shared with any third party, and we will securely delete and erase it from all our systems once the verification process is complete.

WHAT TYPES OF MEMBERSHIPS ARE AVAILABLE?

At present, Eligible Users can only register for a Free Account, which provides access to view Service Advertisers' profiles. However, we may introduce additional membership options with varying features in the future. Should any changes occur, you will be notified in advance via email.

WHAT ARE YOUR OBLIGATIONS TO US?

You agree to and acknowledge the following:

To follow the Acceptable Use Policy.
Not to misuse the information you obtain from the Website.
Not to evade any security feature or functionality of the Website.
Not to use any code or application that interferes with the working of the Website.
Not to use any data mining tools, robots, scripts, or similar data gathering or extraction methods on the Website.
Not to reverse engineer, mirror, deface, harm, modify or decompile the Website.
Not to use the Website for any illegal purposes.

CAN YOU UPLOAD REVIEWS?

Depending on your membership, you may be able to upload reviews about your experience with a Service Advertiser.

You must not upload fake reviews. You must not use abusive, foul or threatening language while submitting a review. Your review must be about your experience with the Service Advertiser. You must not advertise any third party services or products through your review.

Further, due to the inherent nature of the internet and the near impossibility of fully deleting data once it has been published, we always urge Customers to exercise caution and bear this in mind when uploading reviews.

Our Licence in the Review: You retain ownership of all reviews. However, by uploading reviews to the Website, you grant us a limited, royalty-free, non-exclusive, worldwide, sublicensable, assignable, transferable licence in the reviews only to the extent reasonably necessary to enable us to provide and operate the Website. This includes to make available, communicate, display, distribute and translate your reviews. You acknowledge and agree that you will not be compensated for our use of your reviews under the aforementioned licence.

Our Right to Audit the Review: We are not responsible for and do not endorse or hold the opinion contained in any review. We are not obliged to screen the reviews prior to its upload to the Website, nor do we have an obligation or responsibility to monitor the reviews. However, we reserve the right to audit and consider the reviews that are brought to our attention, and to, at our sole discretion, remove or delete or refuse to display a review at any time.

We may report the review to relevant law enforcement authorities if we become aware of, or reasonably believe there is, a genuine threat or risk of harm to any Customers, Service Advertisers, third parties or public health and safety as a whole.

HOW DO YOU PAY?

As part of our website launch, we have decided not to charge any membership fees. However, we reserve the right to introduce a membership fee at a later date. If you wish to continue using your preferred membership at that time, you must pay the applicable fee.

We will notify you in advance by email before any charges are introduced. Under no circumstances, and howsoever arising, will we be responsible or liable for any loss, claim, expense, cost, or damage you may suffer as a result of this change.

WHAT IS ACCEPTABLE USE OF YOUR ACCOUNT?

One of our key philosophies is to provide a space for Customers and Service Advertisers to connect and freely express themselves.

However, given the nature of the Website and the type of content and interactions shared between Customers and Service Advertisers, this unfortunately opens up opportunities for abuse and misuse.

For this reason, there are obligations on your use of your account with us ('Acceptable Use Policy'), as follows:

You must only use your account for your personal use.
You may not use your account to commit an illegal or unlawful activity that contravenes the jurisdictional laws applicable to you.
You may not use your account to upload, publish, circulate or distribute any information, material or content that exploits, harms or abuses, or facilitates or attempts the exploitation, harm or abuse, both indirectly and directly, of children.
You may not use your account to upload, publish or distribute any information that depicts, encourages, facilitates or glorifies: self-harm or suicide, genital mutilation, bestiality, rape or non-consensual relations including intoxication, sexual assault, revenge porn and deep-fakes.
You may not use your account to upload, publish, circulate or distribute another person's personal or private information, such as their names, contact details, identity data, financial details, medical records without that person's prior written consent.
You may not use your account to upload, publish, circulate or distribute information, material or content that constitutes or may be considered violence or hate speech.
You may not use your account to harass, threaten or attack others, whether directly or indirectly, or to incite or organise said action.
You must not use our Website or create account(s) for the purposes of impersonation (catfishing), digital stalking, trolling, distributing disturbing or harmful content, or engaging in grooming or predatory behaviour towards any individual.
You may not use your account to upload, publish, circulate or distribute hate speech or discriminatory speech, such as by harassing, threatening or attacking people or groups based on their age, sexual orientation, gender identity or expression, race, nationality, ethnicity, political affiliations, religious beliefs, cultural beliefs, disability, medical conditions, physical appearance, or any other status group as identified by applicable laws.
You may not use your account to commit fraud, or to intentionally misrepresent or exploits others for financial gain.
You may not use your account to promote, advertise or support any third-party commercial interests, such as sales, product promotions and placements, contests and competitions or any other similar advertising without our prior written consent.
You may not use your account to promote, advertise or support any groups, organisations or platforms that encourage, promote, aid or condone violence, hate speech, or discriminatory speech, including via instruction, co-ordination or encouragement of such activities.

HOW CAN YOU USE OUR WEBSITE?

When you access or register an account with us, we will grant you a limited, non-exclusive, personal, non-transferrable, non-shareable, non-sublicensable, revocable licence to access and use the Website pursuant to these Terms and any additional terms and conditions set forth by us from time to time.

You can access the Website through on your smartphone, tablet, laptop and/or computer.

You are provided with access to this Website for your individual use only. You may not, without our written permission, on sell any information obtained from this Website, use any data mining robots or other extraction tools or metatag or mirror the Website.

Service Advertisers: We make no representations, guarantees or warranties regarding the suitability, safety, ability, availability, reliability, timeliness or creditworthiness of the Service Advertisers, any suggestions or instructions made by a Service Advertiser, any services provided to you by Service Advertisers or any Transaction.
Review/Testimonials: Any review or other matter that could be regarded as a testimonial or endorsement about our Website does not constitute a guarantee, warranty, or prediction regarding the use of our Website and you acknowledge that testimonials represent the anecdotal experience of individual Customers.

WILL YOUR ACCOUNT BE SUSPENDED OR TERMINATED?

You may terminate your membership and delete your account at any time. Such deletion will result in the deactivation of your account and any and all access to it, as well as any saved searches.

We may terminate your membership and/or account if you have, at our sole discretion, materially breached these Terms, and if that breach is capable of remedy, failed to remedy that breach within 7 days after us notifying you in writing of such breach.

We may, in circumstances such as our termination due to your persisting or grievous breach of these Terms, take further measures to restrict your access or use of our Website.

WILL THESE TERMS CHANGE OR UPDATE?

We may vary these Terms by giving you written notice at any time. However, such variations or changes will be effective no earlier than the time written notice is given to you. If you do not agree to any variations or changes, please cease use of our Website and/or Product.

INDEMNIFICATION OF US

General Indemnity: You agree to indemnify, defend and hold us and each of our employees and contractors harmless for and against any and all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs, resulting directly from: (a) a breach or alleged breach by you of these Terms; or (b) a breach or alleged breach by you of an applicable law.

WHAT CAN YOU DO IF A DISPUTE ARISES?

Resolving Disputes with a Service Advertiser: We are an online directory providing a platform for Service Advertisers to advertise their services, upload Content, view the Content, and connect with Service Advertisers. We are not an escort agency, nor do we employ or contract any Service Advertisers. We are in no way liable or responsible for any Transaction between You and the Service Advertiser.

If you have any disputes with a Service Advertiser, you must resolve them directly with them.

Resolving Dispute with Us: If you have a concern about our obligations or warranties as provided under these Terms, you agree and acknowledge to first engage in informal and good faith attempts to resolve the matter. You can do this by emailing us at hello@seductivesecrets.com.au.

Should this fail, the dispute will be submitted to arbitration in accordance with the Commercial Arbitration Act 1984 (VIC). Each party will bear its own legal costs and other costs in relation to any arbitration.

These Terms shall be construed in accordance with and governed by the laws in force in the State of Victoria, Australia and each party irrevocably submits to the exclusive jurisdiction of the courts of Victoria, Australia.

The parties agree to follow this procedure before resorting to any legal proceedings. Nothing in this Agreement prevents a party from seeking urgent injunctive relief.

No Waiver: If we do not take any action with respect to any breach by you or others of these Terms, this does not waive our rights to take action with respect to subsequent or similar breaches. Further, if any part of these Terms is found to be void, unlawful or unenforceable for any reason, then that part will be deemed severed from the remainder of these Terms and will not affect the validity of the remaining clauses.

Change of Control: In the event that we merge, sell or otherwise change control of our business or this Website, we reserve the right and you hereby consent to us transferring, assigning or sublicensing the rights to use of any personal information and/or user content that you have provided to us.
